About the Webinar

This session addresses the legal challenges posed by physician practice use of social media , so as to prevent lurking liabilities.  It will look at specific challenges relating to compliance with HIPAA, and medical malpractice risks, such as the risks posed by employees posting protected health information (PHI) on social media accounts, and how responding to online inquiries can lead to malpractice exposure, with discussion of real-life scenarios.  The session also explores practical, technological, and legal techniques for addressing these risks, including social media policies for physician practices, a discussion of secure messaging, and suggestions for employee training.

Learning Objectives:

  • Explain some of the basic functionality of social media platforms.
  • Analyzing the legal, practical, and technological risks involved in using social media within the physician practice context.
  • Outline practical and legal advice to mitigate such risks.


About the Speaker
Daniel Shay
Attorney

Daniel F. Shay is an attorney with Alice G. Gosfield and Associates, P.C.  His practice is restricted to health law and health care regulation focusing on physician representation, fraud and abuse compliance, Medicare Part B reimbursement, and HIPAA compliance in the physician context.  He also focuses his attention on EHR license agreements, physician advertising, Medicare enrollment, quality reporting and measurement, and physician use of social media.  He has published on all of these topics both in the trade press and in major chapters in the HEALTH LAW HANDBOOK.  Mr. Shay received his Bachelor of Science degree cum laude in 2000 from Vanderbilt University and his juris doctorate degree from Emory University School of Law in 2003.  He is admitted to the Pennsylvania Bar, is a member of the American Health Lawyers Association, and is the Vice Chair of Educational Programs for the American Health Lawyers Association's Physician Organizations Practice Group.
